Abstract: This article analyzes the theoretical and legal representation of the notional category of “social services”. On the basis of scientific knowledge in the field of law, economy, sociology are its legal characteristics, distinct from the concepts of “social services”, “social security”, “support”, “social and vocational rehabilitation”. This social protection refers to interdisciplinary legal categories, the author has formulated the basic signs of the Institute of law.

Modern scientific theories in the field of the legal nature of social services are more often on the subject of management, education, healthcare, social security, etc. The second criterion of classification are actors. The article analyses both directions.

The term “service” is most often found in the rules of civil law and social security law, but it is used and how the term “provision of services”. The notion of “service” and “services” are often used as synonyms in the right and often replace these terms with each other. The author believes that today it became necessary to separate the concept of “the right to services”, “service” and “services”. By analyzing different scientific views and theories on this subject, it proves that need.

These concepts are different legal burden. The concept of “service” is much wider than the rest, and includes a comprehensive set of requirements, such as material, social, cultural, spiritual, property, utilities, etc. Frequently, it appears as a single complex cash and property relations.

Today, roughly following the scientific views on social services. 1. This is the sphere of services (mostly economic theories, including international). 2. social services is presented in the form of monetary obligations. 3. in some cases, social (material service) are in the form of professional and voluntary assistance to individuals, groups or communities to enhance or restore their capacity for social functioning or creating optimal for them social conditions. That is, material security is regarded as a social service. There are other points of view, to justify social services through the provision of services, or as a specific type of service. A special place in this regard are economic research.

A special role in the sphere of social service state. Today, however, the right of the Republic of Kazakhstan there is no concept of a right to services as a separate legal category not provided by the legislation of the Republic of Kazakhstan.
