PROPERTY RELATIONS IN CIVIL LAW: THE THEORY AND PRACTICE

The theory of a subject of civil law, understanding of essence of property relations allows to ascertain that efficiency of economy of any country depends on quality of civil law regulation. Problems of efficiency of the Russian economy are connected, according to the author, including, with absence of statement of the purposes of civil law regulation of property relations. The comparative legal analysis allows to recommend to the Russian legislator to connect the purposes of civil law regulation with achievement of the general welfare consisting in forward development of a society and economic progress. Author proves that despite the importance of quantitative subject of legal regulation, that is, the parameters of the volume of normative impact, more than the essential question is whether the quality or efficiency of the impact on social relations. The author reveals the theory of the subject of civil law, defines the concept its main component – property relations in the article. He formulates a conclusion that the efficiency of market development depends on the quality of civil regulation. An analysis of state economic development in Russia leads to the conclusion that there were serious problems and gaps in the civil legal regulation at this period. The author outlines the "starting point" of civil regulation. It is seen in the goal setting civil regulation, implemented by codified civil law. The author suggests that the current edition of the Civil Code (article 2), reflecting the position of the legislator, was the result of stagnation in the civil doctrine concerning a problem of the subject of civil law. Analysis of the economic situation of today's Russia has shown that a large portion of our revenue comes from sales in international markets of various raw materials. As a result, became apparent low technology and weak competitiveness of domestic economy, making it dependent and inefficient. The purpose of civil law, according to the author, should be a general benefit, which consists in the progressive socio-economic development, which allows to provide the growing needs of its citizens.
