About demarcation of Authority Between Institutions of Local Governing and Institutions of State Governing in the Sphere of Public Order Maintenance

Abstract: In the article to the questions of demarcation of authority between institutions of local governing and institutions of state governing in the sphere of public discipline and public security are considered; the actuality of mentioned above problem because of adoption of Federal law from 07.02.2011 №3-fz «On police» which in contrast with previously existing Law of USSA from 18.04.1991 №1026-1 «On police» imputes obligation of ensuring law and order in public places to the police only is emphasized; the vectors solving the problem of demarcation with the account of secondary legislation acts (decrees of the President of RF and departmental acts of internal Affairs Ministry ) that install the right of territorial bodies of the Ministry of internal Affairs to use the abilities of institutions of state governing of the subjects of the Russian Federation, institutions of local governing, voluntary organizations and different other organizations with the aim of ensuring law and public order are defined; the assessment of novelty of Federal law from 19.07.2011 №247-fz «On amendments to the Federal law «On General principles of organization of local self-government in the Russian Federation» in accordance with according to which institutions of local governing must provide precinct police with the room space and must provide for the proper costs in the local budgets are given; legislative possibilities of institutions of local governing in the spheres of solving the questions of public order protection at the local level and the problems of ahead of the regulation of the questions of public order protection and ensuring law and public order at regional level on account of the introduction in the state Duma the draft law on the establishment of municipal police are indentified; the first experience of establishing and functioning of municipal police in the subject of the Russian Federation and its legal basis are analyzed.
