Fairly often, the constitutional principle fixed in the article 123 part 1, becomes an object of the research. In a science of the constitutional law the content of such beginning comes only to the openness of a stage of the trial. In the article, distinctive features of the provision of the principle at all stages of civil legislation, which are not concerning to a trial, have been revealed: an initiation of proceedings of a civil case in a court and a stage of preparation to a trial. The author concludes, that the given principle is realized at stages prior to a trial, but with those restrictions which are led to the openness and accessibility of court decision and all records of preliminary examination.
