The Questions of Right Subject Structure of the Securities Turn Relations

This article is devoted to a problem of formation of legal model of a securities turn in modern Russia. As one of major factors the subject structure of such legal relationship is allocated. The urgency of researching theme speaks that subjects are a necessary element of any legal relationship. Features of activity and a legal status of subjects influence character of the relations and the mechanism of legal relationship. Legal regulation of securities market subjects activity in Russia developed non-uniformly and was based on different principles. Till 1996 the universal principle, after – a branch principle was applied, and by the present moment the functional principle of regulation is shown. Taking into account radical reforming of the civil and enterprise legislation by the present moment legal and theoretical definiteness in a choice of the main principles of legal regulation is necessary. In article the most characteristic features of reform of legal regulation of a securities turn as a whole are allocated. Taking into account the author's characteristic of features of a turn of securities special subjects, the main approaches to formation of the updated legal model are offered, forecasts concerning development of legislative regulation become. Including, it is offered to prove and offer scientifically to the legislator one of regulation principles: functional or branch, having refused the universal. Including refusal of a some uncertain now in legal aspect of categories is necessary: "investor", "market", "financial instrument". The two-element model of subjects of a turn of securities and two-compound model of specialized operators of activity in the sphere of securities turn is offered. A number of restrictions and special principles regarding the organization of activity of specialized subjects locates.
