PUBLIC AND PRIVATE LEGAL REGULATION OF RELATIONSHIP IN THE SPHERE OF SHAREHOLDING IN HOUSING CONSTRUCTION

The article is devoted to the peculiarities of interaction of private and public elements in civil legal regulation of relationship in the sphere of shareholding in housing construction.

Several cases of interaction of private and public legal regulation of such relationship are analyzed.

The following cases are marked.

First of all, some laws, which contain legal regulations of private law and rules of dispositive meaning, could not only have a private legal way of regulation of such relationship, but also a public legal way of this regulation.

Secondly, practically in any State there are several forms of state control, which are necessary for normal functioning of civil law and transactions. For example, rules of state registration of real estate; the appointed order of operations (and actions) of building organizations in the process of housing construction; and some other legal rules, – all of them are assist to emphasize the importance of such state forms, because social meaning of State and social protection of people have become more significant.

Thirdly, civil laws “work” together with public ones, which “accompany” them, functionate in pair with the first ones. For instance, rules of Law about shareholding in housing construction supplement the laws in the sphere of administrative relations and procedures (about order of state registration of rights on real estate, about insolvency).

Moreover, there are several references in the Law of shareholding in housing construction to the rules of other branches of law: Civil Law; Administrative Law; Law about taxes; Land Law.

Fourthly, because of the fact that relationship in the sphere of shareholding in housing construction are closely connected with social-important objects of civil rights – tenement houses and other objects of real estate, it is appear a necessity of state control and regulation of such relationship.

Fifthly, building organizations – are the organizations of the owner’s sphere and they act in the competitive environment. Competition is a consequence of civil right of freedom and it is also a factor of a development of economic relations. So long as competition needs definite frames and limits, a combination of private and public legal regulation appears.

Finally, people can invest money on the grounds of the issue of housing certificate. Its regulation also needs an interaction of private and civil law.

In the article there are analyzed advantages and disadvantages of the housing certificate.
