| Annotation: | Introduction: the authors of the article consider issues of defining the subject structure of collection activity in the Republic of Tajikistan. Purpose: to research domestic norms and theoretical provisions of civil law science on problems of defining the subjects of collection activity; to analyze characteristic features of collection activity of natural and legal persons; to consider the necessity to fix the provisions regulating legal status of subjects of collection activity in legislation. Methods: general scientific methods (dialectics, abstraction, analysis and synthesis) and specific scientific methods (comparative legal, formal legal, and technical legal) are used. Results: subjects of collection activity are considered as subjects of business activity. The author notes that the absence of the provisions regulating legal status of subjects of collection activity in the legislation of the Republic of Tajikistan results in the possibility to refer any person who is engaged in one way or another in collecting or repayment of arrears to subjects of this activity. Conclusions: collection activity is a professional activity which is subject to licensing. Professionalism in the field is a pledge of successful, legal and competitive activity. The subject of collection activity can only be a legal entity of commercial character (collection organization) and a natural person who is legally connected with the collection organization. In Tajikistan the sphere of business providing collection services is not developed because it is not adequately institutionalized in the Tajik society. Therefore, there is an objective need to systematize the domestic legislation regulating the status of subjects of collection activity. | |||||||||
