The shipping of the obligations is the basic condition of the abstract transaction! Do we have to accept this statement of the outstanding civil scientists of past centuries for granted? Is it possible to say that just the abstractedness of the obligatory agreement, in other words – the absence of the “causa”, is the principal reason for the simple replacement of the creditor or the debtor?
These questions were the objects of the author’s research. The analysis of some scientific works devoted to this problem made him come to the following conclusions.
Here they are: In material contracts the basis (causa) is like the roots of the tree constraining the personal links between the partners of the agreement, and its absence in abstract legal transactions allows the creditor and the debtor to change the contract basis, to carry out the transfer of the obligations, both from an active and a passive side of the deal and all this thanks to a basic superstructure of the similar obligatory relations - their category of shipping.
The indissoluble interrelation of abstractedness and the shipping of the obligations in such agreements is explained by the fact that any requirement of the creditor is, in reality, the property value, and a debt is to be the property encumbrance for the debtor. This circumstance abstracts the obligations, grants the right to the participants of the transaction to fill its "vacuum" with any material contents, to carry out its transfer to other persons at their own will.
In modern civil commodity turnover the reasonable tendency towards the expansion of the usage of abstract transactions is observed (and the Russian market isn't an exception in it) because: "The rights connected with these transactions, depend on smaller number of conditions, than the rights connected with material transactions; they are simpler, they are easier proved and less debatable. Therefore they are freely addressed in life, rendering their incalculable services, and all this because they are put in a conventional attitude irrespective of the “causa” to which different ways of satisfaction are provided" [3, page 710].
