FEATURES OF REALIZATION OF THE PRINCIPLE of Property Inviolability in the Civil Legislation of Republic of Belarus

Establishment and ensuring balance of property interests of the owner, other persons and society as a whole is the main objective of legal regulation of the relations of property. As the criterion allowing optimum to combine interests of the owner and all society and also to guarantee the greatest possible degree of inviolability of property, the criterion of legislative fixing of cases has to act, at which probably compulsory restriction or property right termination. It is necessary to consider that according to Art. 44 of the Constitution the property right termination contrary to will of the owner has to be carried out only in the cases provided by the law, instead of other acts equated to them and is exclusive under the court resolution. When there is a speech about the main beginning of the civil legislation, expanded interpretation of the term "law" is inadmissible.
