The paper examines the influence of precise and secure fixation of Intellectual property rights (IPR) upon social and economic development of the region. This is analyzed on example of interrelations between national legal regulation of protection and use of intellectual property (IP) and innovation activity in developed countries. The accent is made on the analysis of the specific character of legal protection and use of IP in Germany as a country with the developed innovation economy and effective IPR regulation.

Serious achievements of Germany in innovation development are mostly connected with the specific character of its legislation in the sphere of IPR protection. As object of the analysis, Germany is taken, as the country with the most developed innovative economy and the basic partner of Russia in trade area of hi-tech production. Besides, the German patent right has formed a basis of the Russian legislation in the field of protection of intellectual property rights. Among 27 countries of the European Union on which calculation of innovative activity and the patent statistics (EU-27) is conducted, Germany confidently leads in all indicators connected with realization of innovative activity. It is necessary to notice that Germany is also the largest foreign partner of Russia in trade of technologies. The peculiarities of organization and legal protection of scientific and research system of Germany are revealed. The complex of legal rules in the sphere of protection and use of IP is analyzed. The main attention is paid on German patent law and legal regulation of relations between employer and employee, who created the invention. German experience can be very useful for IP legislation improvement. The paper analyzes the peculiarities of legal protection and use of IP in Germany and legal regulation of IP and innovation activity. The specific features of German patent law are distinguished. The recommendations for Russia patent system improvement are formulated.
