Abstract: We investigate the legislative regulation of legal relations in the sphere of invalidation of transactions, including the recognition of public bidding for the implementation of land highlights the main reason the auction is invalid, and discusses their implications and how to use them as a result of the recognition of trading (auction) invalid. Held in the characterization of the existing approaches to the doctrine of legislative regulation of legal relations in the sphere of invalidation of transactions, including the recognition of public auctions for the sale of land. The article examines the existing scientific approaches concerning these issues, justified the author's own position, makes proposals and conclusions aimed at improving the doctrine of law and legislation.
In the domestic judicial practice, there is a wide range of controversial provisions affecting the enforcement of the rules of special legislation. The auction is invalid shall entail the invalidity of the contract concluded on trades. The requirements for the bidding procedures contained in the numerous normative – legal acts governing the organization and conduct of public bidding, differ depending on the type of trading.
The article stresses that scientific approaches to the invalidation of transactions, unfortunately, were not reflected in the current regulatory control of relations arising in connection with the sale of property by public auction (auction). In this regard, the purpose of scientific publication is in the comprehensive study of legislative regulation of legal relations in the sphere of invalidation of transactions, including the recognition of public bidding for the implementation of the land.
