Abstract: Reveals the status of an autonomous institution of the Supervisory Board.carried out an analysis of problems associated with the formation of the supervisory board and the implementation of its functions. Controversial is the question of the legitimacy of the Supervisory Board in connection with the change of the status of its members. For example, if a representative from the public − a member of the Supervisory Board, has entered into an employment relationship with the founder of an autonomous institution. In fact, the number of representatives in the founding of the Supervisory Board to increase. This is a violation of proportions representation on the supervisory board. These proportions are established by law. This circumstance may be a basis for challenging the legitimacy of the decisions of the Supervisory Board. Marked inconsistency of the provisions of law in determining the competence of the supervisory board. It is proposed to add to article 11 of the Federal Law of 03.11.2006 №174-FZ "On Autonomous Institutions" by writing or additional competence of the Supervisory Board to approve the provisions of the procurement or provision to the effect that the supervisory board may implement additional functions provided by other regulations. Indicate the need for amendment of the law on autonomous institutions: changes in the forms of expression of decisions, fixing the consequences of a negative opinion of the Supervisory Board.
