ADDITIONAL SOCIAL SECURITY: ANALYSIS OF THEORY AND PRACTICE

Introduction:the article considers theoretical and practical issues of additional social security. Purpose: to study peculiarities of additional social security at the federal, regional, municipal and corporate levels. Methods: the methodological framework of the research is based on the following methods: universal, general scientific methods, and some methods specific to legal science (systemic-structural, formal-legal, comparative legal methods). Results: the content of Part 3 of Article 39 of the Constitution of the Russian Federation was analyzed. It is concluded that the Constitution of the Russian Federation has established a legal framework for the organization and activity of a substantial block of social-security relations which are of an additional character compared to the relations that make up the core of the subject of social security law. These relations are amenable to separation from interconnected relations. At the same time, these relations can be differentiated according to the levels: federal, regional, municipal, corporate. While analyzing certain levels of additional social security, some weaknesses in legislation and enforcement practice were detected. This refers to federal regulation of the issues of additional social security for senior public officials of subjects of the Russian Federation, deputies of legislative (representative) bodies of state power in subjects of the Russian Federation, heads of municipalities and deputies of representative bodies of local self-government. Pension provision for civil servants of subjects of the Russian Federation and municipal employees also needs rationalization. Conclusions: Additional social security is a relatively independent unit of social security. It is not a part of social support, social assistance or social services. The level of its legal regulation is extremely low, resulting in frequent violations of law in this area. Therefore, there is an urgent need to increase the level of legal support in this sphere.
