Introduction: in the conditions of information economy, the issues of legal regulation of information exchange, creation, storage, multiplication, reproduction and use of information are of great current significance. Nevertheless, there are still a lot of legal collisions and unsolved questions. The necessity to change the order of the state regulation of legal relations concerning creation, storage, dissemination and use of information proves the importance and current relevance of studying this sphere. Purpose: to analyze the essence, nature and main features of legal regulation of information and information objects, to reveal the main problems and suggest possible solutions. Methods: the methodological framework of the research is based on a set of scientific methods with a leading role of analysis and synthesis, methods of interdisciplinary and comparative law approach. Results: it has been established that the insufficient state of Russian legislation has led to ambiguous understanding of the essence of information, its role among other objects of property rights, its correlation with documented information. The question of the possibility to apply the institutions of property rights and intellectual property rights to information resources still remains the most difficult. Conclusions: in order to overcome collisions and contradictions in the information sphere, it is important to apply differential regulation of information as a special object of intellectual property rights. This also refers to creation, storage, reproduction and any other kind of use of information. To improve the legal regulation of information, it is suggested to use a new term “information object”. |
