Expromission, passive delegation and intercession – ways of debt succession

Abstract: Studying ways of debt succession: expromission, passive delegation and intersession, the author of the article has found out that there is no accurate vision of these legal institutes in the civil doctrine. It has become evident for him that in the scientific world there is no consensus not only concerning the name of this or that variant of debt succession but of its implementation conditions as well. He has been trying to understand, whether there is something more than free operation of legal terms. Maybe, the reason of such difference of opinions is hidden in plurality of life situations though the only purpose of named legal transactions is the replacement of the debtor by a new one.

The theoretical material has allowed the author to come to the following conclusion despite of the common features of expromission, passive delegation and intersession, exactly:

1. These legal transactions are followed with the innovative contract which cancels the one between the creditor and the initial debtor.

2. Transactions are carried out by singular (private) succession;

3. The result of these transactions is the change of a passive side of the obligatory relations, these structures have own characteristic categories and we can’t put an equal-sign between them.

For an example, expromission was always accompanied by the innovating contract owing to which the relations of the creditor and the former debtor were completely replaced by legal link between the obligee and the new debtor.

The passive delegation demanded the preliminary contract between the initial debtor and the third person who agreed to replace the latter in the obligatory relations. Besides, the creditor had to express his positive attitude towards the transaction. The result of such actions was full discharge of the former debtor.

As far as intersession is concerned, unlike expromission and passive delegation, it permitted the partial replacement of the initial debtor.
