EXPENSES SUBJECT TO PAYMENT FOR THE TRANSLATION SERVICE
IN THE ECONOMIC (Arbitration) PROCEDURAL LAW OF UKRAINE

Article is devoted to such type of court costs as expenses which are subject to payment for a translation service in an economic procedural law of Ukraine. Value of involvement of the translator in economic process is connected with intensity of investment activity in Ukraine. Participation of the translator provide for execution of expenses by participants of economic process. The status of the translator and procedure for payment of its services isn't settled in the Ukrainian economic procedural legislation. The author finds the limitations and gaps in the right regulation of this payment and offers solutions of the existing problems. Also in the work is analyzed the structure of this types of court costs which consist of the fee of the translator and the reimbursement, connected with an appearance in economic court.

Classification of expenses on the translator depending on the fact of its employment and location is given:

1) Compensation for the lost earnings for the translator who is the employee of the enterprise, establishments or the organizations;

2) Compensation for a separation from usual occupations for the translator who isn't the employee of the enterprise, establishments or the organizations;

3) Remuneration for the performed work for the translator if such work isn't his official duties;

4) Compensation for the expenses in connection with performance by the translator procedural function outside the settlement of the constant place of residence.

It is offered to create the procedure of unpaid involvement of the translator for foreigners who are in difficult financial position that demands changes of the economic procedural and budgetary legislation of Ukraine.

It is offered to pay a translation service on the basis of the civil contract signed between the party of economic process and the translator. To conditions on which expenses on the translator should be paid to the right party are the need of the participant of process for a translation service and communication of these services with economic process.
