PUBLIC REMEDIES IN RUSSIAN AND GERMAN CRIMINAL LAWLegal

Introduction: the article observes the debating points of the theories of the juvenile penal law. Purpose: the objective is to analyze the criminal law of Russia and Germany in terms of the application of compulsory educational measures to minors. Methods: a methodological basis of the study comprises the methods of the scientific knowledge, among which the leading place takes the dialectical method. General scientific (dialectic, analysis and synthesis, abstraction and concretization) and private-scientific methods of the research (formal-legal, comparative legal, technical and legal) have been used. While performing the analysis, the comparative, systematic research methods have been emphasized. The statistics of the educational measures’ application by courts in Russia and Germany have been analyzed as well as the list of such measures in the Russian and German laws has been considered. Results: The practice of the educational compensatory remedies’ implementation in Russia and Germany has been observed. The German law contains the doctrine, according to which the crime committed by a minor, is the lack of education. Moreover the conceptual idea is the need for reconciliation with the victim and remedying the caused damage. The special state social services that can attract non-governmental organizations are responsible for carrying out a whole range of activities, depending on the crime committed and the identity of an offender. The author insists on the need to put out the minors, to which the educational compensatory remedies have been applied, from the treatments of the internal affairs bodies. Conclusions: in the German justice system the educational compensatory remedies to minors, that have proven the effectiveness, are more widely applicable than in the Russian legal system; there is a need to extend the list of legal education measures for minors; to put the minors out the field of view of the Minors Affairs Departments in order to implement a complete corrective pedagogical work by the special social services with them.
